ivari presents contest rules

  1. Sponsor. ivari presents is sponsored by ivari, 200-5000 Yonge Street, Toronto, Ontario, M2N 7E9 (“Sponsor”).
  2. Eligibility. This Contest (“Contest”) is exclusive to advisors who have contracted with ivari (“Advisors”). This Contest does not apply to employees of the Sponsor, its parent, related and affiliated companies, subsidiaries, departments or agencies, franchisees, suppliers, advertising and promotional agencies, Contest administrators, and any other parties engaged in the development, production or distribution of contest materials, and those living in the same household. By participating in this Contest, participants acknowledge compliance with, and agree to be bound by, these Contest Rules. No purchase necessary by Contest participants.
  3. Contest Dates and Times. This Contest begins on September 16, 2021 and ends on October 12, 2021(“Contest Period”).
  4. Contest Details. The purpose of the Sponsor is to motivate Advisors, who have contracted with the Sponsor, to view the “ivari presents” webinar recordings, in an effort to raise awareness regarding the library of on demand recordings (“Contest Goal”).
  5. How to Participate: Each week, the Sponsor will post a new ivari presents webinar on ivari.ca directed at educating its Advisors. One skill testing question will also be posted alongside each webinar based on the content of each video. Advisors may enter their answers on the secure ivari website forms.ivari.ca/ivaripresents-contest. All Advisors who correctly answer the weekly questions posted by October 8, 2021, will be automatically entered in a weekly draw.
Entries are limited to one (1) entry per SA code. The prizes will be awarded to four randomly selected Advisors who correctly answer the maximum number of questions during the weekly video.
  1. Draw: On October 11, 2021, at approximately 2:00 pm EST, four (4) Advisors will be selected by random draw from all eligible entries received during the Contest Period. The odds of winning depend on the total number of eligible entries received during the Contest period.
  2. Prizes: There will be four (4) prizes available to be won. Each prize will consist of one (1) ivari boutique $100 (CAD) gift card. The prize must be accepted as awarded. The Sponsor reserves the right to substitute any prize item with another prize item of comparable value if a prize item cannot be awarded as described for any reason. This prize is non-transferable and is not redeemable for cash or credit, in whole or in part.
  3. Awarding the Prize: The four (4) winning participants will be contacted by an e-mail indicating that he/she has won the prize before the prizes are announced on social media and ivari info. The participants may be required to provide proof of eligibility and will not be declared an official winner until all the conditions described in these rules have been met. If according to the Sponsor’s sole discretion the participant does not comply with the contest rules, the winner will be deemed to have forfeited the prize and the prize may be attributed to another participant. Alternate winners will be selected upon forfeiture of the prize, or in the event that the Sponsor receives notice from a winner that they are declining the prize. Refusal to accept the prize releases the Sponsor from any obligation toward the winner. Final contest results are at the sole determination of the Sponsor.
  4. Release and Indemnification. All participants must sign a Release to: (i) confirm compliance with all Contest Rules; (ii) release, discharge and hold harmless the Sponsor, its departments and agencies, parent, related and affiliated companies, subsidiaries, franchisees, advertising and promotional agencies, counsel, marketing partners, and each of their respective directors, officers, employees, shareholders, successors, sponsors, partners, licensees, subsidiaries, agents, artists, Advisors, assignees, and all others associated with the administration, development and execution of the Contest (“Released Parties”) from and against any and all manner of action, cause of action, claim or demand, loss or injury, use or misuse of an award, suit, debt, covenant, contract, including legal fees and expenses, whatsoever, including but not limited to, claims based on negligence, breach of contract and fundamental breach, failure of any third-party contractor or supplier used in connection with any aspect of the Contest to perform or deliver any goods or services, any act of God or any other event beyond the Released Parties’ control, any dissatisfaction of any kind by a participant with any aspect of the Contest, celebration party or any award, liability for physical injury, death, or property damage which the participants, guests, their heirs, successors or assigns have, might have or could have suffered, by reason of or arising out of the participant’s participation in the Contest and/or in connection with the acceptance of any award; and (iii) indemnify the Released Parties against any loss, damage or expense, including legal fees, that any of the Released Parties may suffer or incur as a result of any non-compliance by participants with any of the Contest Rules or participation in the Contest and/or in connection with the acceptance of an award or attendance at the celebration party.
The Sponsor is not responsible for: (i) incorrect or inaccurate information that may affect a person’s ability to participate in the Contest or be recognized as a top performer, including but not limited to human error, technical malfunctions, lost or delayed entries for any reason, mail failures, omission, or any combination thereof, and entries that fail to fully comply with these Contest Rules; (ii) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software;  (iii) injury or damage to participants’ computers or to any other individual’s computer related to or resulting from participating in, or downloading any material regarding the Contest or accepting an award; (iv) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from participant’s participation in the Contest or receipt or use or misuse of any award; or (v) the security or privacy of information transmitted via computer networks or for breaches of privacy due to interference by third-party computer hackers or otherwise.
  1. Other Conditions. The Sponsor reserves the right to terminate or amend this Contest at any time and in any way, without prior notice to participants.
  2. Publicity and Participant Information. By participating in the Contest, participants consent to the use of their name and image, whether on videotape, photograph or any other means, for the administration of the Contest or any publicity carried out by the Sponsor, without further notice or compensation.
  3. Law. The Contest is void where prohibited by law and is subject to all applicable Canadian federal, provincial, territorial, municipal and local laws. This Contest shall be governed exclusively by the laws of the Ontario, including all issues and questions concerning the construction, validity, interpretation and enforceability of these Contest rules, rights and obligations between participants and the Sponsor, and procedural provisions, without giving effect to any choice of law or conflict of law rules. Any dispute shall be adjudicated by the courts sitting in Toronto, Ontario.
  4. Rule Amendments. The Sponsor reserves the right, in its sole discretion, to amend or modify these Contest Rules, or modify, cancel or suspend this Contest, without prior notice for any reason whatsoever, including without limitation in the event that any cause beyond the reasonable control of the Sponsor corrupts, or threatens to corrupt, the security or proper administration of the Contest.
  5. Intellectual Property. All intellectual property, including but not limited to trademarks, logos, designs, promotional materials, web pages, source codes, images, drawings, illustrations, slogans and representations are owned by the Sponsor. All rights reserved.Unauthorized copying or use of any of the Sponsor’s intellectual property without the express written consent of the Sponsor is strictly prohibited.
  6. By entering, you agree to abide by the contest rules and the decisions of ivari, which decisions are final and binding on all contestants.
  7. Contest rules (and any amendments thereto) are available on ivari.ca/ivaripresents-contest-rules.
  8. Any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling. Any litigation respecting the awarding of a prize may be submitted to the board only for the purposes of helping the parties reach a settlement.
